By accessing or using the RFQplus website (rfqplus.co) or submitting a request for quotation, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Advanced Tech Solutions LLC ("RFQplus", "we", "our", or "us").
If you do not agree to these terms, please do not use our services.
RFQplus is a sourcing intermediary that connects buyers of custom CNC machined and turned parts with a vetted network of US-based manufacturers. Our services include:
RFQplus acts as an agent on your behalf but does not itself perform manufacturing operations.
Submitting an RFQ does not constitute a binding order or purchase commitment. A binding agreement is only formed upon your written acceptance of a formal quote and our confirmation of that acceptance.
Quotes are valid for the period specified therein. We reserve the right to withdraw or revise a quote before your written acceptance if material costs, availability, or other relevant factors change.
You are responsible for the accuracy and completeness of all technical specifications, drawings, and requirements you provide. We are not liable for errors or costs arising from inaccurate or incomplete information.
You retain full ownership of all technical drawings, CAD files, specifications, and proprietary information you submit. By submitting these materials, you grant RFQplus a limited, non-exclusive license to use them solely for the purpose of sourcing and fulfilling your order.
We treat all submitted technical information as confidential and share it only with the manufacturing partner selected to fulfill your specific order. Upon request, we will execute a Non-Disclosure Agreement (NDA) prior to sharing any materials.
We do not retain, resell, or otherwise exploit your intellectual property beyond the scope of your order.
Payment terms are established at the time of order confirmation and specified in the applicable quote or invoice. Unless otherwise agreed in writing:
Delivery timelines are estimates provided in good faith and are not guaranteed unless expressly stated in writing. We are not liable for delays caused by manufacturing issues, material shortages, carrier delays, or other circumstances beyond our reasonable control.
Risk of loss or damage transfers to you upon delivery of parts to the carrier or upon your acceptance of delivery, whichever occurs first.
We warrant that parts delivered will conform to the specifications agreed upon in writing at the time of order. This warranty does not cover defects caused by your misuse, improper storage, or modification of parts after delivery.
Claims for non-conforming parts must be submitted in writing within fourteen (14) days of delivery, accompanied by documentation of the defect. Accepted warranty claims will be remedied by replacement or credit at our discretion.
This warranty is exclusive and in lieu of all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
To the maximum extent permitted by applicable law, RFQplus's total liability for any claim arising out of or related to these terms or our services shall not exceed the amount paid by you for the specific order giving rise to the claim.
In no event shall RFQplus be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, even if advised of the possibility of such damages.
You are solely responsible for determining whether any parts, materials, or technical data you submit are subject to the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), or other applicable export control laws.
You must notify us in writing before submitting any ITAR-controlled or export-controlled technical data. We will work with you to implement appropriate handling procedures. We do not accept ITAR data without a prior written compliance agreement.
These Terms of Service are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising from these terms or our services shall be resolved by binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.
We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a revised date. Your continued use of our services after such changes constitutes acceptance of the new terms.
